                                                              December 11, 2001

        The Hull Board of Selectmen meeting was called to order at 7:30pm on Tuesday evening, December 11, 2001 at the Hull Municipal Building, 253 Atlantic Avenue, Hull, Massachusetts.

Present:        Timothy MacKenzie, Chairman; Joshua Cutler, Vice Chairman; Thomas Burns, Clerk; John Reilly, and Regina Burke, Members. Also present was Phil Lemnios, Town Manager, and James Lampke, Town Counsel.

                                                                 Open Forum

        During the Open Forum at the start of the meeting citizens were present to object to the Selectmen's approval of a Cohasset project being permitted to tie into Hull's sewer line.

        Cutler stated an open forum is not the place to discuss their concerns and suggested the matter be placed on the agenda.

        Richard Cleverly appeared to suggest commending the Salt Water Club for the "gorgeous" Mariners Park.  

7:45pm - Memo from Town Counsel re Liquor Renewal Procedures

        A memo from Town Counsel, James Lampke, to address Burns' concerns on license renewals without a report from the Police chief was the basis for discussion

MOVED-Burns:    Prior to any license renewals the Board should get some kind of sign-off from the Police Chief with a recommended disposition.
SECOND-Burke

        Burke asked if the motion was restricted to liquor licenses, to which Burns responded that it did.

        Cutler commented that the Chief does that 52 weeks a year. If there is a license a member questions a hold can be put on it, which is what has been done before.

        Reilly agreed and objected to the police report being received by the Board without the Board requesting it. He stated that the report discussed parking violations, which does not have anything to do with a liquor license. Reilly commented that no one knows if the parking violator was at Bridgeman's or not. He stressed the point that the Board is the license granting authority and no one else should step into its role.

        Bartley Kelly, owner of the Gun Rock House, Lawrence Kellem, of the Hull Chamber of Commerce, and Leonard Hersch as president of the Nantasket Beach Merchants Association spoke in agreement with Reilly and Cutler and said the Board has seventy Rules and Regulations that apply to issuing alcohol licenses.

        MacKenzie also agreed and said hotel and restaurants cannot be held responsible for the way people park.

        Burke said it is not her belief that the Board should put anyone under a microscope, and that her impression was to get an overview.

        MacKenzie said he does not want to grant new and sweeping authority,  and asked Burns to restate his motion.

Substitute Motion-Reilly:       To review the Board's current policies and procedures.

Cutler added that you first have to vote to accept the substitute, which was voted and approved with three ayes, and two nays (Burns and Burke)

8:15pm - Hugh Reid-Applicant Park & Recreation Committee

        Reid, the only applicant, appeared before the Board seeking to fill the vacancy on the Park & Recreation Committee.

MOVED-Cutler:   To appoint Mr. Reid

8:30pm - Richard O'Donnell-Applicant for Historical District Commission

        O'Donnell appeared before the board requesting to fill the vacancy on the Historic District Commission. Cutler pointed out to O'Donnell that the commission is not regulatory, but there to advise and assist. O'Donnell agreed.

        The Board recessed at 8:50pm and returned at 8:56pm

                                                        Liquor Licenses

MOVED-Cutler:   To allow liquor establishments to stay open until 2:00am on New Years Eve

MOVED-Reilly:   To approve the renewal of the following license on the list presented for the December 11, 2001 meeting, subject to the final sign-off and approval of the applicable inspectional services and agencies adopted by the Board, unless a hold is placed thereon by a Board member in which event said licensees shall be considered separately:

The following licenses were Unanimously approved for renewal on a motion by Reilly, seconded by Cutler except for #14 which was seconded by MacKenzie - Cutler abstained from voting on #14:

        Following a brief discussion in which Burns asked to review Sgt. DiMarzio's police report, which Reilly said was unasked for, Cutler asked to release #2.

MOVED-Reilly:   To grant the license subject to no junk vehicles or parts to be kept on premises.

        Cutler asked that licenses 3 & 4 be heard next week. Also to request a representative of the Clarion Hotel to appear next week for clarification of license renewal request.

                                                      Correspondence

Noted a letter of Appreciation from George Burke of Rockaway for correcting the lighting problem coming from George Washington Boulevard.

Unanimously approved recommended charges in Medicompt memo for ambulance services on a motion by Reilly, seconded by MacKenzie.

Tabled until next week action on approval of the exemption of interest for Paula Whalen, Hull Cultural Council member.

Noted a biohazard drill scheduled for Wednesday, December 12th 0930 hours.


MOVED-Cutler:   To go into executive session to conduct strategy sessions in preparation for negotiations with nonunion personnel and conduct contract negotiations with nonunion personnel.
